Goodman Gallery UK Limited ("Goodman Gallery," "we," "us," or "our") is a company registered in England and Wales under company number 10928960, with its registered office at 727-729 High Road, London, N12 0BP, United Kingdom, and its trading address at 26 Cork Street, London, W1S 3ND, United Kingdom. Our VAT number is GB 380 1061 28.
By placing an order with Goodman Gallery online, you agree to be bound by these Terms of Sale ("Terms"). These Terms govern the sale and purchase of artworks, editions, books, and other products offered by Goodman Gallery. You must be at least 18 years old to place an order with Goodman Gallery.
All items that are sold are either as agent for artist who we represent, or owned by the gallery. The full list of artists that we represent is set out on our website. Acceptance of these terms shall be demonstrated by full or partial payment of the price shown on the front of the invoice for the relevant product or edition.
We strive to provide accurate descriptions of all products, including artworks and books. Descriptions will specify the condition (e.g., new, good condition, or with noted defects). Images shown are for illustrative purposes only and may not exactly represent the item.
- All prices displayed on the website exclude shipping, VAT and any other rel taxes. All rel taxes and shipping costs will be determined at checkout when the shipping destination has been determined.
- We accept payment by credit or debit card and other payment methods as displayed on the website.
- Payment is due in full at the time of purchase unless otherwise agreed in writing.
- If payment fails, we may cancel the order
- The remitter of funds is responsible for all bank charges
- If an invoice is paid in a currency other than the currency of the artwork, the amount will be converted at the prevailing rate at the time of payment. Goodman reserves the right to restrike the exchange rate if the invoice is not paid within 7 days of the pro forma invoice being issued. If a deposit is taken, any outstanding amount will be converted again at the time of the payment of the outstanding balance or part thereof.
- All goods remain the property of Goodman Gallery UK Limited until paid for in full.
- Sold artworks not yet delivered after two months from final payment (at the request of the purchaser), will attract a storage fee of $50 per artwork per month, to be settled prior to the release of the goods.
- All taxes, custom duties and shipping to be borne exclusively by the buyer. These costs will vary depending on the circumstances of the transaction and Goodman Gallery reserve their right to adjust these costs on this invoice accordingly.
- Goodman Gallery will have a right of first refusal to purchase the artwork(s) if the client decides to sell them.
- In accordance with EU anti-money laundering regulations, the gallery can only receive payments from a bank account held in the name of the person or entity named on this invoice.
- All orders are subject to acceptance by Goodman Gallery.
- We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspicion of fraudulent activity.
- Goodman Gallery is required by UK laws and regulations, to comply with EU anti-money laundering regulations (AML) and the South African Financial Intelligence Centre Act, No. 38 of 2001, as amended (FICA). Due to the effective date for implementation of the regulations, all new and existing clients need to be verified before a sale can be concluded. This applies to transactions with a value over 10,000.00 EUR (or equivalent in another currency) ex VAT.
- When you place an order, you will receive an acknowledgment email confirming receipt of your order. This email does not confirm acceptance of your order.
- Your contract is formed only when we send you a confirmation of dispatch.
Risk in the goods passes to you upon delivery or collection. However, title (ownership) of the goods remains with Goodman Gallery until full payment, including any fees or expenses, has been received.
- We deliver to the UK and internationally.
- Delivery charges and estimated delivery times will be shown at checkout or by email confirmation from our post sales team.
- We will take reasonable care to deliver within the estimated time but are not liable for delays beyond our control.
- Goods will be dispatched to the delivery address you provide. You must ensure the address is accurate.
- Risk in the goods passes to you upon delivery and upon delivery. It is your responsibility to check the condition of the item received and notify us immediately if there are any concerns with it’s condition of the item or artwork purchased.
- If you do not receive your order within the estimated delivery time, please contact us.
The majority of the items that we sell are either original artist or artist editions and pls note that editions may exclude not only items on paper but also sculptures and apparel. This means that your statutory cooling off rights to cancel, do not apply within 14 days of the items being purchased.
Pls note that all artworks purchased including editions, are non-refundable and cannot be returned unless they are damaged, in which case pls contact us immediately upon delivery so this can be answered.
For all non-artworks purchased, you have the right to cancel your order within 14 calendar days of receipt ("cooling-off period"), except for:
- Custom, bespoke or personalised items
To cancel, please notify us in writing and return the goods in their original condition and packaging. You are responsible for return shipping costs unless the item is faulty or not as described.
Refunds will be processed within 14 days of receiving the returned item.
If goods arrive damaged or faulty, please contact us immediately with photographic evidence. We will arrange for a replacement, repair, or refund at our discretion.
If goods are not delivered or collected after 2 months, by choice of the purchaser, Goodman Gallery may charge storage fees of £50 per month per artwork to cover storage and insurance.
- You must inspect goods upon receipt and report any discrepancies or defects immediately. Failure to do so may limit your rights.
- You must comply with all applicable import, export, and customs regulations when ordering.
All intellectual property rights in the products remain with the respective artists or Goodman Gallery, unless otherwise stated. You may not reproduce or use images, descriptions, or any intellectual property without prior written consent.
Goodman Gallery shall not be liable for any delay or failure to perform its obligations due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, or government restrictions.
Except for death or personal injury caused by negligence, our liability is limited to the price paid for the product. We exclude liability for indirect or consequential losses.
We collect and use your personal data as set out in our Privacy Policy. By purchasing, you consent to this use.
These Terms are governed by English law, and disputes shall be subject to the exclusive jurisdiction of the English courts.
